These terms govern your use of the Axis application and the optional Axis Cloud service ("Axis", "the Service"), operated by the party named in the Imprint ("we", "us"). By installing or using Axis, you agree to these terms.
Axis is independent, third-party software for editing and backing up presets on Fractal Audio devices. It is not affiliated with, endorsed by, or sponsored by Fractal Audio Systems.
Axis is licensed under the terms shipped with it (PolyForm Noncommercial) — noncommercial use only. You agree not to misuse the Service: no unlawful use, no attempts to break, overload, or gain unauthorized access to the infrastructure, no uploading of unlawful content, and no reverse-engineering of the hosted services.
You are responsible for your hardware and presets. Always keep your own backups. Writing to a hardware device carries inherent risk; you use device-write features at your own risk. Preset content you create or upload remains yours; using Axis Cloud grants us only the limited permission needed to store and sync it back to you.
You must provide a valid email and keep your credentials secure; you are responsible for activity under your account. You may delete your account at any time (see the Privacy Policy §8); we may suspend or terminate accounts that violate these terms.
Axis is beta software, provided "as is" and "as available". Features may change, break, or be removed, and the cloud service may be unavailable or reset during the beta.
To the extent permitted by law, the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that it will not affect your device or presets.
To the extent permitted by applicable law: we are liable without limitation for damages caused intentionally or by gross negligence, and for injury to life, body, or health. For slight negligence, we are liable only for breach of a material contractual obligation (Kardinalpflicht), limited to the foreseeable, typical damage. Any further liability is excluded. In particular, we are not liable for data loss or damage to your device, provided you have kept reasonable backups.
Axis Cloud and diagnostics rely on third-party processors (Supabase, Grafana Labs; a payment provider for the paid tier). Their terms and availability also apply; we are not responsible for their outages.
We may update these terms; the current version lives at https://axisapp.live/terms. Continued use after a material change constitutes acceptance. If you do not agree, stop using the Service and/or delete your account.
These terms are governed by the law of the Federal Republic of Germany, excluding the UN CISG. Mandatory consumer-protection provisions of your country of residence remain unaffected.
